USER AGREEMENT
These Conditions of Sale are AmericanBottleClubAuctions.com entire agreement with the seller and purchaser relative to the property listed in our catalogues and online offered for sale. These Conditions of Sale and the contents listed in our catalogues are subject to amendment by us at any time, amendments issued by the posting of notices or by oral announcements made during the auction.
1. The property sold at Auction will be offered by Premier members to sell on our site. By bidding at the auction, whether in person or by agent, by verbal, written or electronic methods, or by any other means through AmericanBottleClubAuctions.com, the buyer and seller agrees to be bound by the following Conditions of Sale:
2. REGISTRATION. All bidders and sellers for AmericanBottleClubAuctions.com auctions must be a registered user registered with AmericanBottleClubAuctions.com.
3. TOTAL PURCHASE PRICE. The total purchase price of each lot owed by the purchaser is the amount of the SUCCESSFUL BID PLUS A BUYER'S PREMIUM as set by the premier member selling the item(s).Unless exempt by law, all purchases (including a buyer's premium) are subject to local sales or use tax in the seller’s state for residents with shipping destinations within the same state as the seller.
4. SHIPPING AND INSURANCE. Shipping and insurance costs are determined by the seller and must be described in the terms of sale in each premier member’s auction offerings.
5. PURCHASER'S RESPONSIBILITY. Upon the fall of the auctioneer's hammer, title transfers immediately to the highest acknowledged bidder subject to the premier member’s terms of sale agreement. Such bidder/purchaser assumes full risk and responsibility for the lot(s) and will pay the full purchase price, Buyer’s premium, shipping costs and applicable local tax.
6. PAYMENT. Payment must be received to seller and must be in compliance with the terms of sale in each premier member’s auction offerings.
7. NON-PAYING BIDDERS. Payment is due immediately after the receipt of your invoice as described in the premier member’s terms of sale. If payment has not been received within 31 days after receipt of invoice the sale will be canceled and the non paying bidder will lose future bidding privileges. Furthermore, the Non Paying bidder shall be in default of this agreement.
8. SUCCESSFUL BIDDER DISPUTES. The highest bidder acknowledged by the auctioneer will prevail as the successful purchaser. In the event of a dispute between bidders, the auctioneer has sole and final discretion to determine the successful bidder, to cancel the sale, or to re-offer and resell the lot in dispute. If a dispute arises after the sale, AmericanBottleClubAuctions.com decision of record will be final. AmericanBottleClubAuctions.com, at our discretion we will execute absentee bids, (including written bids), telephone bidding, which is provided as a convenience to clients who are not present auctions. These are additional services that can be provided by AmericanBottleClubAuctions.com for an additional fee. AmericanBottleClubAuctions.com is not responsible for any errors or omissions by AmericanBottleAuction.com or members posting on the site.
9. LIABILITY. In no event will AmericanBottleClubAuctions.com be held liable to any purchaser for auctions posted by premier members. All lots must be guaranteed authentic and to be accurately described as to condition by the premier members selling the item. All selling members must agree that a purchase may be returned within ten (14) days if inaccurately described. All return requests must be made immediately upon receipt of the item(s) All disputes are solely the responsibility of the seller and buyer as per the sellers terms of sale.
10. BIDDER'S & SELLER’s AGREEMENT. These Conditions of Sale constitute the entire agreement relative to the subject auction between the bidder, seller and AmericanBottleClubAuctions.com and may not be amended, changed, modified or altered unless countersigned by an authorized representative of AmericanBottleClubAuctions.com
